iPhone Hacking: The government’s cybersecurity agency CERT-In has started its investigation into the issue of the Apple threat notification received by several opposition MPs, and a notice has been sent to the company, IT Secretary S Krishnan said on Thursday.

The move assumes significance as the Minister of State for Electronics and IT Rajeev Chandrasekhar had earlier this week said that the government wants Apple to clarify if its devices are secure and why ‘threat notifications’ were sent to people in over 150 countries, given the company’s repeated claims about its products being designed for privacy.

The government will investigate the threat notifications and also Apple’s claims of being secure and privacy-compliant devices, Chandrasekhar had penned in a post on X (formerly Twitter) on Tuesday, after several opposition leaders claimed ‘state-sponsored’ attack notification were sent to them from Apple and the government ordered a probe.

IT Minister Ashwini Vaishnaw has categorically rejected the opposition’s attack on the government, saying “compulsive critics” were indulging in the politics of “distraction”, as they could not tolerate the country’s progress under the PM’s Narendra Modi leadership.
On Thursday, S Krishnan, Secretary, IT Ministry confirmed that notice has been sent to Apple.

“CERT-In has started its probe… They (Apple) will cooperate in this probe,” Krishnan told reporters on the sidelines of an event related to the Meity-NSF research collaboration.

Indian Computer Emergency Response Team or CERT-In is the national nodal agency for responding to computer security incidents as and when they occur.

Asked if a notice has been sent to Apple, the IT Secretary answered in the affirmative. Apple did not reply to an email by PTI seeking comments on the notice.

Several opposition leaders on Tuesday claimed they have received an alert from Apple warning them of “state-sponsored attackers trying to remotely compromise” their iPhones and alleged hacking by the government.

Whitehall sends out notification letters after cyber attack


City administrator Zach Woodruff said the city did not pay the ransom and was able to retrieve the files that were compromised.

WHITEHALL, Ohio — The city of Whitehall has sent out 37,000 notification letters to people in 11 states and one U.S. territory alerting them that their personal information may have been compromised following a ransomware attack that happened in late May.

When asked why it took city administrators until December to notify those potentially affected, a city administrator told 10 Investigates that it has taken this long to identify those who may have been impacted.

City administrator Zach Woodruff also told 10 Investigates that after learning of the breach in late May, the city hired a law firm and a cybersecurity firm to help determine what happened.

Woodruff said the city did not pay the ransom and was able to retrieve the files that were compromised. He added no one from the city would be available for an interview.

Following the ransomware attack in late May, the city tweeted out on May 31 that “City Hall is closed to the public for the remainder of the day following technology issues. Our apologies for any inconvenience.” The tweet did not specifically mention the ransomware attack that occurred days earlier.

On Tuesday, the city posted a notification of the data breach to its website and included a Frequently Asked Questions tab should those impacted need to know more information.

The city is offering credit monitoring services as well.

Among the people impacted was Gregory Hensley who told 10 Investigates he hasn’t lived in Whitehall since 2014 but received a letter in the mail saying he was impacted. was concerned because he and his late wife were the victims of identity theft in the past.

App-etite for Notification: FTC Says “Welcome to the Jungle” to Mobile Health App Developers in Policy Statement on Health Breach Notification Rule | Wyrick Robbins Yates & Ponton LLP


Last week’s news that the Federal Trade Commission is taking steps to begin rulemaking on consumer privacy and artificial intelligence drew plenty of attention from privacy professionals, and suggests 2022 could be an interesting year for federal regulation of privacy and data security. But that development is only one of a series of moves the Commission has recently made in this space.  In September, a divided Commission issued a Policy Statement that adopts a surprisingly broad interpretation of the FTC’s existing Health Breach Notification Rule, and suggests the FTC is seeking opportunities to use its existing authority to crack down on mobile health apps’ lax privacy and data security practices.

In that Policy Statement, the FTC takes the position that the Health Breach Notification Rule, which applies to “vendors of personal health records,” covers any mobile app that processes health information and that can draw personal information from multiple sources. The FTC also states that the Rule broadly requires notification of any unauthorized access to consumer health information, including the sharing of a consumer’s health information without the consumer’s authorization.

Mobile health app developers should take careful note of the Policy Statement’s interpretations and assess their offerings’ compliance posture accordingly.

Overview of the Health Breach Notification Rule

The FTC issued the Health Breach Notification Rule in 2009 to impose breach notification requirements on companies that process consumer health information, but are not subject to HIPAA. To that end, the Rule requires a “vendor of personal health records” to notify affected consumers and the FTC whenever  “unsecured [personal health record] identifiable health information [is] acquired by an unauthorized person” as a result of “a breach of security of unsecured [personal health record] identifiable health information.” A “vendor of personal health records” is an entity that (1) is not a HIPAA covered entity or business associate and (2) offers or maintains “personal health records.”
