WhatsApp, Facebook Malware Suit to Continue After 9th Circuit Denies Foreign Sovereign Immunity Claims


A federal appellate panel sided with the WhatsApp messaging app and its parent company Facebook on Monday after denying a private, Israeli corporation’s claims of foreign sovereign immunity to dismiss a suit alleging it sent malware through WhatsApp’s server to mobile devices.

WhatsApp Inc. and Facebook Inc. filed a suit against the NSO Group Technologies Ltd. and its parent company, Q Cyber Technologies Ltd., in October 2019. NSO that designs and licenses surveillance technology to governments and government agencies for national security and law enforcement purposes.

9th Circ. Nixes NSO’s Immunity Bid In WhatsApp Hacking Suit


By Hailey Konnath (November 8, 2021, 9:23 PM EST) — The Ninth Circuit on Monday said a California federal judge was correct to refuse to find Israeli spyware company NSO Group immune from litigation over an alleged WhatsApp hacking, ruling that the Foreign Sovereign Immunities Act doesn’t protect private companies.

The three-judge panel shot down NSO’s argument that it could claim foreign sovereign immunity under doctrines that apply to foreign officials, noting that the law governing the issue “has roots extending back to our earliest history as a nation.”

SolarWinds Hit With Del. Derivative Suit Over Sunburst Hack


By Katryna Perera (November 5, 2021, 7:55 PM EDT) — Current and former directors of information technology company SolarWinds have been hit with a stockholder derivative suit in Delaware’s Chancery Court over claims they were at fault for the massive hack and data breach that affected governments and private businesses around the globe last year.

The complaint filed by shareholders Thursday states the suit is in response to the directors’ “utter failure to implement or oversee any reasonable monitoring system concerning … cybersecurity risks fundamental to SolarWinds’ only line of business.”

US SOCOM Still Looking for High-Tech Upgrades After ‘Iron Man Suit’


  • The Pentagon is looking to keep its edge over rivals by giving US troops the best tech out there.
  • US Special Operations Command has been leading the way, often providing real-world testing for various weapon systems and technology.
  • With its Hyper Enabled Operator program, SOCOM aims to equip special operators with technology to better understand the battlefield without impairing their ability to fight.

For years, the Pentagon has been looking to maintain its competitive edge over its near-peer competitors by outfitting US troops with the best technology out there.

The US Special Operations Command, known as SOCOM, has been a pioneer in this effort, often providing real-world testing for various weapon systems and technology that eventually is widely distributed among conventional forces.

This effort stalled amid decades of fighting technologically inferior enemies in Afghanistan and Iraq, but the return of great-power competition, this time with China and Russia, has brought the need for technological superiority to the fore.

Central to this push for tech is SOCOM’s Hyper Enabled Operator program, known as HEO.

SOCOM has already experimented with equipping commandos with advanced weaponry and sensors. In 2013, the command introduced the Tactical Assault Light Operator Suit, or TALOS.

TALOS was an Iron Man-style exoskeleton meant to give special-operators several advantages over adversaries. The program was canceled after a few futile years, but the concept lives on in the HEO.
