China says new cybersurveillance proposal follows US security practices

China is scratching its head over why the U.S. is opposing a new anti-terror law relating to cybersurveillance when the U.S. and other countries have also requested that tech companies hand over data to help stop terrorists.

On Wednesday, China’s parliamentary spokeswoman tried to play down the impact the proposed legislation might have on foreign tech businesses, in the face of U.S. fears it would require companies to hand over sensitive data to the country’s government.

The anti-terror law is still under review, but if passed, it would require tech companies to give encryption keys to the authorities, and create “back doors” into their systems for government surveillance access.

White House privacy proposal aims to give consumers control over data

U.S. businesses that collect personal data would be required to describe their privacy and security practices and give consumers control over their personal information under a proposed privacy bill of rights released Friday by President Barack Obama’s administration.

The proposal would also require companies and nonprofit groups to collect and retain only the personal data they need to operate.

However, the proposal allows industry groups to submit their own codes of conduct to the Federal Trade Commission and shields companies that follow those codes from FTC enforcement actions.

Warning to white-hat hackers: Obama proposal a threat to what you do

President Obama’s proposal to update the computer fraud and abuse act could put white-hat hackers at risk of prosecution as members of organized crime, the SchmooCon hacking conference was told.

Under Obama’s proposal, simply sharing passwords with friends – something hackers do routinely – could be enough to indicate that the person doing the sharing is involved in an organized criminal activity. That would set them up for punishment under the federal law designed to prosecute crime kingpins, the racketeer influenced and corrupt organizations (RICO) act.

“It seems to criminalize sharing information that aids an attack,” Joseph Lorenzo Hall, chief technologist at the Center for Democracy & Technology, a Washington, D.C.-based group lobbying for Internet rights, told the SmooCon hacker conference.

The Obama administration wants phone companies, not the NSA, to be responsible for storing bulk phone record metadata and for quickly handing over retained records if the government supplies a new type of surveillance court order.
